Insurance Requirements
Licensee shall, at its own sole cost and expense, procure the following insurance naming the railroad, and its officers, directors and employees, as additional insured. The following insurance shall be kept in force during the life of the Occupancy License Agreement:
Commercial General Liability Insurance
Railroad Protective Liability Insurance (during construction or maintenance only)
The limits of coverage under each of the required insurance policies will be in an amount not less than two million dollars ($2,000,000.00) per occurrence, Six million dollars ($6,000,000.00) aggregate liability for each specific project. These insurance requirements will be contained in the license agreement covering your project when it is approved by the railroad.
Evidence satisfactory to LICENSOR’S General Counsel of LICENSEE’S authorized self-insurance program capable of providing for such limits, will be accepted in lieu of a policy from a commercial carrier. This clause shall not serve in any way to limit LICENSEE’S liability to the
amounts of insurance required.

Prohibited Uses of Railroad Property
Storage of hay and/or straw
New residential use, except for a lease on an existing house encroaching on railroad right of way (usually granted)
Use of an existing railroad fireguard road for applicant’s convenience
Electrical transformer repair or reconditioning
Wood treatment / tie plant
Salvage operation, junk yard (including vehicles), scrap dealers (unless salvaging railroad materials)
Battery recycling
Tire storage or recycling
Any type of material recycling, reconditioning, reclamation or recovery operation
Landfill, incinerator, and waste disposal of any kind
Surface impoundments, waste piles
Above or underground storage tanks (some exceptions may apply on a case by case basis)
Electroplating operation
Mining, ore processing, refining, smelting
Fuel blending, waste or used oil recycling or reclamation
Explosive disposal, manufacturing or detonation
Leather tanning
Electrical machinery manufacturing and repair
Petrochemical refining
Automotive repair and service stations
Bulk oil storage
Machinery degreasing operations
Cement kiln
Laundry or dry cleaner
All chemical manufacturing or processing operations, including:
Industrial organic or inorganic chemicals
Plastics, synthetic resins, synthetic rubber
Paints, pigments, lacquers, enamels, varnishes
Solvents
Soap, detergents and cleaning preparations
Perfumes, cosmetics, toiletry preparations
Agricultural preparations
Pesticides
Fertilizers
Wood preservatives
Drugs
Adhesives, printing ink, black carbon
