Procedure for Requesting Occupational Installations on Railroad Right-of-Way
When considering to occupy railroad property, the following guidelines must be followed:
The first step in the application process is to determine the name of the railroad to be occupied. There are two ways to obtain the railroad name.
All online applications, procedures and specifications are in Adobe Acrobat format (PDF). If you do not have the Adobe Acrobat Reader program or are unable to read the documents, a current version can be downloaded from Abobe at their website located at: www.adobe.com
If for some reason you are still unable to get the application using the above Option 1 or Option 2, an application can also be obtained by email request or by telephone at (904) 264-1560.
Generally, requests submitted by email receive priority responses. When an application and drawings/plans are received by Interstate Management Group, Inc. (IMG), they are reviewed for accuracy. After they are approved by this office, the documents are forwarded to the appropriate railroad departments for further review. Several railroad departments will perform the review during the process to determine whether the application can be approved. The review and subsequent permitting process generally takes three to six weeks, however, an Expedite fee can be submitted for faster service. If the application is approved, the applicant will receive an agreement via U.S. Mail or, in some cases, by email which will be in Adobe Acrobat format (PDF). The agreement will outline all of the conditions and terms required by the railroad along with the insurance requirements. The agreements have previously been reviewed by railroad counsel and as such, cannot be changed without an additional review by the railroads counsel. Should a review become necessary, additional fees will apply.
Agreements sent to an applicant and not returned signed within three (3) months will be considered cancelled. All questions concerning the current status of an agreement must be submitted to Interstate Management Group, Inc. by email. All such requests submitted by email will receive a priority response. Railroad property may not be used for any reason until the applicant has received a fully executed agreement. |
